McKinney-Vento Act (Homeless Education

Serving our District's students experiencing homelessness, unaccompanied youth, and their families by ensuring school stability and providing support services for academic success.

Federal law mandates the elimination of educational barriers facing homeless children and youth to increase school stability and participation.

Students are considered homeless or in transition if they lack a fixed, regular, and adequate nighttime residence under the McKinney-Vento Homeless Assistance Act reauthorized by Title IX, Part A of the Every Student Succeeds Act (ESSA).

Children and youth experiencing homelessness have the right to:

  • Immediate enrollment, even without records normally required for enrollment
  • Transportation to and from the student's school of origin
  • Academic access and success. This includes free meals and all other academic supports.

Unaccompanied youth (youth not in the physical custody of a parent or guardian) must be enrolled in school immediately, even if they do not have a parent or guardian present.

School Selection & Student Rights

A homeless student can attend the last school of enrollment, if feasible, or a homeless student can attend the school in the area where the family is temporarily residing.

  • Students can remain at selected school site throughout the duration of homelessness.  The school site is considered the school of origin.
  • If the family gains permanent housing, the student can remain at the current school for the duration of that academic year.
  • Homeless students who are not attending their school of residence do not have the right to attend the next matriculating school.  The student must attend the school in the area in which he/she/they are temporarily residing.

Enrollment

Schools must immediately enroll homeless students, regardless of the lack of:

  • Academic Records
  • Proof of Residency
  • Medical Records
  • Immunization Records

The enrolling school should immediately contact the last school of attendance to obtain missing records.
